And creditors cannot deny you credit because you receive public &lt;br /&gt;assistance income, or because of your age (unless you're under 18).&lt;br /&gt;If you feel like you've been discriminated against, notify the creditor &lt;br /&gt;right away. They may see their error and reverse the decision. For more &lt;br /&gt;information on your rights and actions you can take, visit www.ftc.gov  or &lt;br /&gt;call 1-877-FTC-HELP.&lt;/p&gt;&lt;p class="mobile-post"&gt;How to stamp out bad credit card offers&lt;br /&gt;If you're like me, your mailbox is usually stuffed with things like bills...&lt;br /&gt;postcards selling some turbo-charged Internetservice...maybe a few &lt;br /&gt;magazines...and, of course,  credit  card offers.&lt;br /&gt;It's the credit card offers that get you. They're pretty tempting, aren't &lt;br /&gt;they? Whether it's being pre-approved for $10,000, or the promise of earning &lt;br /&gt;free airline tickets, there's always something that lures us in.&lt;br /&gt;While you might get a few good offers every now and then, most should be &lt;br /&gt;sent right to the shredder. The trick is, knowing which ones should stay�and &lt;br /&gt;which ones should go.&lt;br /&gt;Be choosy&lt;br /&gt;Keep one thing in mind: if you have a couple of credit cards you're happy &lt;br /&gt;with, try not to apply for more cards. Each time you apply, it shows up on &lt;br /&gt;your credit report. And that can make you look credit hungry. It may also &lt;br /&gt;lower your credit score.&lt;br /&gt;When you do decide you need a new credit card�or you are applying for your &lt;br /&gt;first one�ask yourself: what kind of card do you want? You can get one with &lt;br /&gt;reward points. Or miles. Or even a card that helps you save. With so many &lt;br /&gt;cards out there, you don't have to jump at the first offer you get in the &lt;br /&gt;mail. Shop around.&lt;br /&gt;Learn the lingo&lt;br /&gt;You've probably noticed that credit card offers come with what looks like a &lt;br /&gt;lot of legal mumbo jumbo. But these are the terms and conditions of the &lt;br /&gt;credit card, and they explain what fees and finance charges you could pay &lt;br /&gt;when you use the card.&lt;br /&gt;Every card has different terms and conditions. To shop for the best deal, &lt;br /&gt;you need to know what the main terms mean. Here are some to look out for:&lt;br /&gt;Annual Percentage Rate (APR)�This is the yearly percentage rate charged when &lt;br /&gt;a balance is held on a credit card. This rate is applied each month that you &lt;br /&gt;carry a balance (the lower APR, the better).&lt;br /&gt;Annual Fee�Yearly fee associated with having the credit card. Unless you are &lt;br /&gt;getting rewards or miles, or something extra, you may want to look for a &lt;br /&gt;card without an annual fee.&lt;br /&gt;Grace Period�A period of time during which you are allowed to pay your &lt;br /&gt;credit card bill without being charged a finance and/or late fee. This &lt;br /&gt;period is usually 10-28 days.&lt;br /&gt;Introductory Rate (or Intro APR)�A temporary, lower annual percentage rate &lt;br /&gt;that is raised later. Make sure you know what the rate will go up to after &lt;br /&gt;the intro period is over.&lt;br /&gt;Other fees�Also check for the amount of the late payment and cash advance &lt;br /&gt;fees.&lt;br /&gt;Why wait? Activate&lt;br /&gt;Once you receive your new card in the mail, activate it right away. Then put &lt;br /&gt;it in your wallet or in a safe place. Otherwise, you may set the card down, &lt;br /&gt;forget about it, and it could end up in the wrong hands.&lt;br /&gt;As you use your card, keep an eye on your bill and the charges listed. Also, &lt;br /&gt;you should get&lt;br /&gt;your 3-Bureau Credit Report  on a regular basis to make sure no one else is &lt;br /&gt;using your account. In short, probably not. Student loan debts are non-dischargeable in Chapter 7 Bankruptcy cases unless paying the debt would cause the debtor "undue hardship." This basic rule also applies to Chapter 13 Bankruptcy cases.&lt;br /&gt;&lt;br /&gt;Discharge of student loans received popularity in the 1970's. Many individuals would file for bankruptcy shortly after completing their expensive education. The goal was to discharge these student loans before they began earning money&lt;br /&gt;&lt;br /&gt;The wording of the exception of a "hardship discharge" and what is considered a student loan has recently been broadened so that most student loans made by nonprofit groups or the government are now considered student loans. This only applies to the actual student and not a co-signor. So a parent signing for one of their children could not have this debt discharged. In addition, this exception does not include debts to an educational institution for tuition. If the loan is non-dischargeable then the petition on the loan is also not going to be discharged.&lt;br /&gt;&lt;br /&gt;So we turn to "undue hardship." Most published court opinions agree that "undue hardship" means more than garden variety hardships that come with the costs of future payments. Several circuit courts of appeals have developed a three-prong test. &lt;br /&gt;&lt;br /&gt;In summation, the debtor cannot maintain a minimal standard of living and his dependents are left with the debt, some additional circumstances in regard to the standard of living would extend over the life of the repayment of the loan, and the debtor has tried to the best of their ability to pay off the loan according to the plan. &lt;br /&gt;&lt;br /&gt;The ideal debtor who will successfully discharge student loans are the low-income debtors. The debtor has the burden of proving their hardships. Any reason that makes this loan impossible for the debtor should be made known to your attorney. Many times people aren't sure what the concept of credit repair is all about.&lt;br /&gt;  &lt;br /&gt;  &lt;b&gt;CREDIT REPAIR IS RELEVANT TO EVERY ONE WITH CREDIT&lt;/b&gt;&lt;br /&gt;  Fundamentally, credit repair is about making sure that all of your credit items reported to Equifax and TransUnion (credit bureaus) are accurate, complete and verifiable.&lt;br /&gt;  &lt;br /&gt;  If you've got credit cards, lines of credit, or any other type of personal credit, chances are that these items are being reported to the credit bureau, or will be if you don't make your payments.&lt;br /&gt;  &lt;br /&gt;  &lt;b&gt;THE LAW - ACCURATE, COMPLETE AND VERIFIABLE.&lt;/b&gt;&lt;br /&gt;  The law states that all items reported on your credit reports must be accurate, complete and verifiable.  All items that are being reported about your must be true and correct.  This is reasonable.  &lt;br /&gt;  &lt;br /&gt;  This is such a serious topic that there are laws dedicated to the regulation of credit bureaus such as Equifax and TransUnion.&lt;br /&gt;  &lt;br /&gt;  &lt;b&gt;MOST CREDIT REPORTS AREN'T ACCURATE&lt;/b&gt;&lt;br /&gt;  While most credit items are reported routinely and correctly to the credit bureaus, some definitely aren't.  This is true for people who have good credit and bad credit.  I have met very few people who have a credit report that is 100% accurate, complete and verifiable.&lt;br /&gt;  &lt;br /&gt;  The reality is that credit bureaus are managers of information.  They receive millions of credit items from creditors, collection agencies, government departments, etc to manage each month.  &lt;br /&gt;  &lt;br /&gt;  Problems usually occur when credit items are handled by many employees.  &lt;br /&gt;  &lt;br /&gt;  I've seen people with good credit, denied more credit because their name was spelled wrong, or because their address was spelled incorrectly etc.  I've also seen collection items, judgements, repossessions, bankruptcies that are recorded incorrectly.  &lt;b&gt;THIS HAPPENS ALOT!&lt;/b&gt;&lt;br /&gt;  &lt;br /&gt;  The first step in credit repair is knowing about credit report problems.  In order to know about problems with your credit report you need to get copies of your credit reports from BOTH &lt;a href="http://www.express-credit-repair.com" title="credit repair canada" target="_blank"&gt;Equifax and TransUnion&lt;/a&gt;&lt;br /&gt;  &lt;br /&gt;  The second is to learn about what is being reported and which creditors are reporting on your credit reports.  Equifax and TransUnion are similar, however they do report a little differently.&lt;br /&gt;  &lt;br /&gt;  Once you have studied your credit reports thoroughly you'll probably pick up on some errors that have occured.&lt;br /&gt;  &lt;br /&gt;  &lt;b&gt;HOW DO I START DOING CREDIT REPAIR?&lt;/b&gt;&lt;br /&gt;  If you've determined that some items on your credit reports are NOT accurate, complete or verifiable, it's time to start disputing these items.  Keep in mind, you've got the law on your side. As members of a reporting agency, we have the right to do so. I suggest you become more familiar with the Collection Agencies Act which explicitly states what we can and cannot do.&lt;/blockquote&gt;&lt;br /&gt;&lt;br /&gt;&lt;p&gt;You've just gotta love it when a brain washed collection agent gets on a forum such as this and starts talking out of his hat.  I ask everyone who has now talked to consumer protection about a collection agency pipe up and answer this kind of post.&lt;br /&gt;&lt;br /&gt;This makes me furious.&lt;br /&gt;&lt;br /&gt;There is NO LAW that says anybody has to deal with a collection agency. Thus, the only way you have to deal with a collection agency is by contractual agreement.&lt;br /&gt;&lt;br /&gt;The same goes for a collection agent giving your personal information to a credit bureau such as Equifax Canada or TransUnion Canada.  There are laws saying that collection agencies need your permission to give out your information to any third party.&lt;br /&gt;&lt;br /&gt;SEE &lt;a href="http://www.privcom.gc.ca" title="PIPEDA - Federal Privacy Commission" target="_blank"&gt;PIPEDA - Federal Privacy Commission&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;Companies have to get your permission to collect and report your personal information.  If they don't have that permission in writing, you can, and should,  complain about them.&lt;br /&gt;&lt;br /&gt;This collection agent doesn't really understand the law very well.&lt;br /&gt;&lt;br /&gt;There is no law saying that a collection agent must give your personal information to Equifax or TransUnion. For me, it's my eighth grade yearbook picture...the video of my karaoke &lt;br /&gt;debut...all the junk under my bed...and the personal information in my &lt;br /&gt;credit report.&lt;/p&gt;&lt;p class="mobile-post"&gt;While we can keep most of our private stuff private, your credit report is &lt;br /&gt;the one thing some outside parties have permission to access.&lt;/p&gt;&lt;p class="mobile-post"&gt;When someone requests a copy of your credit report, it's called a credit &lt;br /&gt;inquiry. But exactly who can look at your credit report? And, how do these &lt;br /&gt;inquiries affect your credit score?&lt;/p&gt;&lt;p class="mobile-post"&gt;Here's looking at you, kid&lt;br /&gt;To keep any Joe Schmo from getting their hands on your report, the Federal &lt;br /&gt;Fair Credit Reporting Act (FCRA) restricts access to your credit &lt;br /&gt;information. Generally, only businesses and parties with "permissible &lt;br /&gt;purpose" can view your credit report. Examples of permissible purpose &lt;br /&gt;include accessing a credit report for a credit application, the underwriting &lt;br /&gt;of insurance, in connection with determining eligibility for a license or &lt;br /&gt;government benefit, or for a business transaction initiated by a consumer.&lt;/p&gt;&lt;p class="mobile-post"&gt;In other words, anyone with a legitimate business need can gain access to &lt;br /&gt;your credit history. This includes creditors, lenders, insurers, and &lt;br /&gt;landlords who need to review your credit as a part of an application &lt;br /&gt;process. Employers and potential employers can also request your report, but &lt;br /&gt;only with your permission. Anyone who obtains a copy of your report under &lt;br /&gt;false pretenses can be fined substantially and jailed for up to two years.&lt;/p&gt;&lt;p class="mobile-post"&gt;Of course, you have every right to know who is looking at your credit &lt;br /&gt;report. There's a section on your credit report  that lists everyone who &lt;br /&gt;accessed your report in the last two years.&lt;/p&gt;&lt;p class="mobile-post"&gt;Once you know who is looking at your report, you may start wondering how &lt;br /&gt;these inquiries affect your credit score.&lt;/p&gt;&lt;p class="mobile-post"&gt;Hard vs. soft inquires: what's the difference?&lt;br /&gt;There are two types of inquiries: hard and soft. When you apply for a &lt;br /&gt;mortgage, car loan or other credit, a lender is authorized to request your &lt;br /&gt;credit report. This is a hard inquiry, and this type of inquiry can impact &lt;br /&gt;your credit score.&lt;/p&gt;&lt;p class="mobile-post"&gt;When businesses do a credit check to offer you pre-approved offers of credit &lt;br /&gt;or insurance it is a soft inquiry, which does not affect your score. Soft &lt;br /&gt;inquiries may also be generated under other circumstances, such as when a &lt;br /&gt;utility company or a company you already have an account with looks at your &lt;br /&gt;report. Requesting your own report from a company like TrueCredit is also a &lt;br /&gt;soft inquiry.&lt;/p&gt;&lt;p class="mobile-post"&gt;Let's get back to hard inquiries. These play a part in your credit score &lt;br /&gt;because you initiate the inquiry. If there's a long list of applications for &lt;br /&gt;credit cards on your report, you may look credit hungry in the eyes of &lt;br /&gt;lenders. This could make you a higher risk, so your credit score may drop.&lt;/p&gt;&lt;p class="mobile-post"&gt;The story is a little different when it comes to secured loans. Looking for &lt;br /&gt;a mortgage or car loan  may cause several lenders to request your credit &lt;br /&gt;report, even though you're only after one loan. Because of this, multiple &lt;br /&gt;auto or mortgage inquiries in a two to three week period may count as just &lt;br /&gt;one inquiry depending upon the creditor�and could have little impact on your &lt;br /&gt;credit score.&lt;/p&gt;&lt;p class="mobile-post"&gt;Do you know who should look at your credit report the most? You. By ordering &lt;br /&gt;your 3-in-1 Credit Report a few times a year, you can make sure it's &lt;br /&gt;accurate. And remember, any time you request your report from a company like &lt;br /&gt;TrueCredit it's a soft inquiry, so your score is not affected.&lt;br /&gt;If you're still in a quandary when it comes to credit inquiries, visit the &lt;br /&gt;Credit Learning Center.&lt;/p&gt;&lt;p class="mobile-post"&gt;Dear Audrey,&lt;/p&gt;&lt;p class="mobile-post"&gt;Over the past few months, we have discovered that various accounts have been &lt;br /&gt;opened in my mother's name. Only after an account that she currently has &lt;br /&gt;(and has had for approximately 14 years) raised her interest rate did we &lt;br /&gt;find this out.&lt;/p&gt;&lt;p class="mobile-post"&gt;Approximately, one year ago my mother relocated to another state and it &lt;br /&gt;seems that quite a few of these accounts were opened after her move.&lt;/p&gt;&lt;p class="mobile-post"&gt;Peggy T.&lt;br /&gt;Milwaukee, Wis.&lt;/p&gt;&lt;p class="mobile-post"&gt;Dear Peggy,&lt;/p&gt;&lt;p class="mobile-post"&gt;Two things could have happened: Your mother may be the victim of identity &lt;br /&gt;theft, or there is simply a mix up with someone with the same name.&lt;/p&gt;&lt;p class="mobile-post"&gt;The first thing she'll need to do is get the facts. She should get her &lt;br /&gt;3-in-1 Credit Report and go through it with a fine-toothed comb. If she &lt;br /&gt;finds inaccurate or fraudulent information on her credit report, she should &lt;br /&gt;start by contacting her creditors to see if they can correct the error. If &lt;br /&gt;the creditor does not resolve the inaccuracy, or if the account is &lt;br /&gt;fraudulent, your mother can then contact the credit bureaus that have &lt;br /&gt;reported the data. If the data is inaccurate she can file a formal dispute &lt;br /&gt;to have it removed; or, if she deems that it is a case of identity theft, &lt;br /&gt;she can request a fraud alert to be added to her credit reports.&lt;/p&gt;&lt;p class="mobile-post"&gt;If the accounts are fraudulent, she should also ask her creditors for &lt;br /&gt;cancellations on any fraudulent activity. Your mother can also visit the &lt;br /&gt;Federal Trade Commission online to file a complaint and an identity theft &lt;br /&gt;affidavit. This will not only help your mother as she resolves fraudulent &lt;br /&gt;accounts with creditors, but it will also help the government track identity &lt;br /&gt;theft trends.&lt;/p&gt;&lt;p class="mobile-post"&gt;Lastly, she should sign up for a credit monitoring service. These are some pretty strong points.&lt;br /&gt;#1 Read something every day about money.  This means concentrating on make money an actual priority.&lt;br /&gt;Learning about it and getting into control with it.  Reading about money programs your subconscious about it.&lt;br /&gt;As you get money thoughts engrained into your head, you'll get better at understanding the short term and long term&lt;br /&gt;implications of how you handle your money.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;  &lt;br /&gt;&lt;b&gt;Are You In Control Of Your Money? &lt;/b&gt;&lt;br /&gt;By Amy Sorkin&lt;br /&gt;Advertising Special Sections Writer &lt;br /&gt;&lt;br /&gt;Suze Orman and Ramsey suggest investing in a Roth IRA. "It’s the best retirement vehicle you’re going to find, bar none," says Orman. &lt;br /&gt;&lt;br /&gt;"If you’re 30 years old and save only $100 a month in a ROTH IRA until you’re 70, you’ll have $1,001,000," says Ramsey. "So you can retire a millionaire on $100 a month. That’s pizza and cable money." &lt;br /&gt;&lt;br /&gt;Robert Kiyosaki suggests being more proactive than simply investing for the long term and diversifying. But it’s an absolute prerequisite that if you take a more proactive route, you need to get well educated before you start making more risky investments. &lt;br /&gt;&lt;br /&gt;Money rules!&lt;br /&gt;&lt;br /&gt;Here are a few money rules to keep in mind, based on the collective knowledge of our experts:&lt;br /&gt;• Read something every day about money.&lt;br /&gt;• Save something — even if it’s as little as $10 — every month.&lt;br /&gt;• Never loan money out of a 401K plan or use it to pay off credit card debt. &lt;br /&gt;• Never close down your credit card accounts once you’ve paid them off. If you do this you’ll hurt your FICO score.&lt;br /&gt;• Never open up a lot of department store cards where you use more than 50% of the available credit. That will hurt your insurance premiums. &lt;br /&gt;• A will is not enough in most states. We'll call this person Mrs X.&lt;br /&gt;&lt;br /&gt;Mrs X has bad credit and we had a lovely chat while reviewing her credit reports, of course with both Equifax and TransUnion.&lt;br /&gt;&lt;br /&gt;I found a surprising response to most of my questions.  My questions weren't all that difficult.  They went something like this:&lt;br /&gt;ML "Is this your debt.  What can you tell me about this debt?"&lt;br /&gt;&lt;br /&gt;The reply to most of the items was, "I honestly can't remember.!"&lt;br /&gt;At that point I wasn't shocked that this person had bad credit.&lt;br /&gt;&lt;br /&gt;If you've got credit and don't have a head for numbers.. PLEASE make very loud reminders for yourself when things need to be paid etc.  Make notes of every contract that you've signed with every company.  &lt;br /&gt;&lt;br /&gt;Quite frankly.. not remembering your debts is not an eligible excuse for not paying them.  Creditors will still get mad at you and sue you for not paying them.&lt;br /&gt;&lt;br /&gt;SERIOUSLY.. this person had credit items that were literally 10 years old and still plaguing her.
